General Terms and Conditions

1.         General provisions

The following general terms and conditions (GTC) are an integral part of all written contracts with Z2 Physio GmbH. Oral statements are not binding. Deviating GTC of national or international contractual partners do not form part of the contract.

2.         Scope of application

The business relationship begins with the patient's signature on the treatment contract/patient registration form. At the latest, the GTC are considered accepted at the start of the first treatment session. The GTC apply to the use of the premises of Z2 Physio GmbH, as well as to the use of the premises of the cooperative partner Let's Go Fitness Dübendorf (LGF DUB). In addition, the respective GTC of LGF DUB apply to the use of LGF DUB premises (see the GTC of LGF DUB).

3.         Treatment requirements

Z2 Physio GmbH undertakes to conduct treatments to the best of its knowledge and abilities and to adhere to new scientific findings. The treatments are carried out with the aim of treating the patient holistically. However, a certain level of cooperation from the patient can be expected, as it significantly influences the success of the treatment. Therefore, Z2 Physio GmbH cannot guarantee a cure.

All therapy measures and treatments are decided and selected in consultation with the patient. For optimal therapy planning, the patient is obligated to provide comprehensive answers to all questions regarding personal information, health situation, previous therapy progress, medication intake, etc., and to communicate all relevant information to the therapist.

A physiotherapeutic treatment is generally only carried out based on a medical prescription. The patient is obliged to bring a valid prescription to the initial appointment or submit it beforehand. A physiotherapeutic treatment covered by the mandatory health insurance (KVG) or accident insurance (UVG) without a valid prescription is not possible.

In order to optimize therapy, it may be beneficial to consult the doctor, other relevant healthcare providers, or engage in internal team discussions among therapists. In such cases, the patient releases Z2 Physio GmbH/the treating therapist from their obligation of confidentiality.

If a patient refuses to cooperate, the necessary level of trust is no longer present, or relevant information and details are withheld, leading to an incomplete or inaccurate medical history or diagnosis, the therapist is entitled to terminate the treatment. Z2 Physio GmbH does not assume any liability for damages resulting from the patient withholding information.

4.         Treatment

A regular therapy session is scheduled for 30 minutes. This consists of approximately 25 minutes of therapy time and approximately 5 minutes of administrative time for the therapist.

Z2 Physio GmbH aims for a duration of 60 minutes for the initial treatment. The additional time allows for the completion of all relevant administrative tasks, the creation of a treatment plan, as well as the execution of a physiotherapeutic treatment.

For a passive physiotherapeutic treatment, physical contact often becomes a basic requirement. Therefore, the patient should be prepared to remove certain articles of clothing and is encouraged to dress appropriately. For an active physiotherapeutic treatment, independent movement by the patient is a fundamental requirement. Hence, it is recommended to bring comfortable/sporty clothing and suitable footwear.

5.        Patient well-being

Z2 Physio GmbH strives to provide patients with efficient, effective, and competent treatment, ensuring their comfort and well-being. As a patient, we encourage you to communicate any discomfort or concerns you may have. This includes aspects such as the position on the treatment table, room temperature, lighting, and more. We also appreciate feedback if you feel uncomfortable with a particular therapy approach. Through open communication, we can explore alternative treatment options if needed. If you ever find yourself unsure about the purpose of a question or the need for specific information, we are more than happy to provide you with the background and context within the therapy.

6.        Full legal age

The patient confirms that they have reached the age of majority (at least 18 years old) and are fully capable of entering into legal agreements. If the patient is a minor or has limited legal capacity, the consent and signature of a legal guardian are required.

7.         Facilities

Z2 Physio GmbH provides treatment rooms for therapy sessions. Additionally, under the supervision of a therapist, the patient can utilize the training area of LGF DUB. Moreover, the patient is allowed to use the waiting area, changing rooms, restroom facilities, and shower areas of LGF DUB.

Independent use of the training area and wellness facilities outside of therapy sessions is only permitted by purchasing a subscription or day pass at LGF DUB. The specific terms and conditions of LGF DUB apply in this case.

8.         Prices/ Payment

For physiotherapeutic treatment based on a medical prescription, billing will be done directly with the health insurance (KVG) or accident insurance (UVG). If the costs are rejected by the accident insurance, they will be covered by the health insurance. Therefore, the patient is required to provide Z2 Physio GmbH with both insurance details. The prices are determined according to the legal regulations using the "Tarifstruktur der Physiotherapie" (tariff structure for physiotherapy).

Additional services or private treatments are either paid on-site or through an invoice. The invoice must be settled within 30 days from the date of invoicing. If the health insurance (KVG) refuses to pay for already provided treatments, the patient is obligated to cover the incurred costs. If the patient falls behind with payments, Z2 Physio GmbH is entitled to immediately suspend further treatment.

In case of payment default, a CHF 20.- expense compensation fee will be charged for the second reminder. After two unsuccessful reminders, debt collection proceedings will be initiated or the case will be handed over to a collection agency. Any additional costs incurred in this process will be borne by the patient.

9.         Appointments/ Cancellations/ Lateness

Appointments that have been agreed upon should be attended as scheduled. As a support, Z2 Physio GmbH strives to send timely appointment reminders to the patient.

Appointment cancellations or rescheduling can be communicated free of charge in person, online, via email or by phone up to 24 hours before the scheduled appointment. Changes regarding Monday appointments can also be communicated online or via email over the weekend. The timestamp of the email will be considered for determining the timely notification.

In case of late cancellations or failure to attend appointments, the patient will be billed privately for CHF 50.-. The patient will receive a separate invoice for this charge. The reason for the cancellation cannot be taken into consideration and includes factors such as illness or issues with public transportation.

The therapy is based on the tariff structure and not on the duration of the session. Therefore, any delays caused by the patient do not obligate the service provider (Z2 Physio GmbH) to extend the treatment time. In case of delays, the treatment time will be shortened accordingly.

In the event of an absence on the part of Z2 Physio GmbH, efforts will be made to find a suitable replacement. If this is not possible, a last-minute cancellation may occur. The patient does not have a claim for compensation as a result of such a cancellation.

10.       Communication with the treating physician

In order to provide optimal care for the patient, he/she authorizes Z2 Physio GmbH to contact the treating physician. This includes making inquiries and requesting relevant patient documents. For this purpose, the patient releases Z2 Physio GmbH/the therapist from confidentiality obligations (see point 3).

11.       Patient Registration

In order to ensure optimal care for the patient and to efficiently collect all relevant data, Z2 Physio GmbH provides a "Registration Form" as well as a "Health Questionnaire". These forms summarize the most important administrative data and patient information. Therefore, Z2 Physio GmbH kindly requests all patients to fill out the mandatory fields of the forms conscientiously and provide as much detail as possible in the optional fields.

12.       Clients right to withdraw

If the patient is not satisfied with the services provided by Z2 Physio GmbH, he/she has the right to terminate the treatment contract. This will result in the termination of the therapy, including the cancellation of all further treatment services. However, it's important to note that any services already rendered will need to be fully paid for.

13.       Z2 Physio GmbH right to withdraw

Z2 Physio GmbH has the right to terminate the contract if the patient violates the existing terms and conditions or behaves improperly. Any services already provided will be invoiced, and payment is required immediately upon receipt of the invoice.

14.       Disclaimer of liability

The Z2 Physio GmbH excludes any liability for damages to the patient resulting from non-compliance with the terms and conditions or due to the patient's misconduct or negligence. The Z2 Physio GmbH is not liable for damages to personal property of contractual partners, unless such damages were intentionally or willfully caused by employees of the Z2 Physio GmbH. Furthermore, no liability can be assumed for theft within the premises of the practice.

The Z2 Physio GmbH occasionally refers to third-party websites on its homepage in the interest of transparency and patient information. However, the Z2 Physio GmbH assumes no liability for the linked websites or their content. The referred websites are selected and regularly checked for their content to the best of their knowledge and belief. However, no liability can be assumed if the content is changed or services are discontinued.

15.       Change of the General Terms and Conditions, Service Description and Prices

Changes to the Terms and Conditions, service description, or prices will be communicated to the patient in writing through notices displayed in the clinic or on the website. These changes are considered accepted if the patient does not submit a written objection within 14 days after receiving the notification.

16.      Data protection/ Data transmission

Z2 Physio GmbH protects personal patient data and treats it confidentially. The collection, use, and processing of data are carried out only to the extent necessary for comprehensive patient care. For the transmission of confidential data, Z2 Physio GmbH provides a separate, encrypted email account.

The patient is obliged to promptly notify Z2 Physio GmbH of any relevant changes in contract data (e.g., insurance changes) as well as personal data (e.g., change of residential address).

17.       General conduct

Z2 Physio GmbH strives to create a space where individuals can thrive, trust is built, and healing is supported. In order to achieve this, we kindly ask for your cooperation as a patient. Please refrain from making loud noises or engaging in phone conversations within the practice premises. If you are unable to attend a scheduled appointment, please notify us in advance. Please arrive on time for your appointments to support the smooth running of our practice. We sincerely appreciate your cooperation.

18.      Severability clause

If any provision of these terms and conditions is found to be invalid, it shall not affect the validity of the other provisions. If a provision of these terms is only partially invalid, the remaining part shall remain valid. The parties are obliged to replace an invalid provision with a valid provision that comes as close as possible to the economic purpose of the invalid provision.
